1. Who this applies to
This policy covers visitors to omegaxp.com, people who submit any form on the site, and clients engaged for services. It is written to comply with India’s Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000. Where a visitor is in a jurisdiction with additional protections, we apply the higher standard.
2. What we collect
Information you give us. When you submit a form, book a consultation or email us: your name, email address, phone number, company name, and whatever you choose to write in a message or brief field. If you use a pricing tool on this site, we also store the options you selected and the resulting estimate.
Information collected automatically. IP address, browser type and version, device type, operating system, referring URL, pages viewed, time on page, and interaction events. This is collected through the analytics services listed in section 5.
Session recordings. Microsoft Clarity records how you move through this site mouse movement, scrolling, clicks and page transitions. See section 5 for what this means and how to opt out.
Payment information. If you pay us, card and banking details are handled entirely by our payment processor. We never see, store or have access to your full card number.
We do not knowingly collect data from anyone under 18. If you believe a child has given us personal data, write to us and we will delete it.
3. Why we use it
- To respond to your enquiry and provide a quote
- To deliver services you have engaged us for
- To send you a document, estimate or breakdown you asked for
- To issue invoices and meet tax and accounting obligations
- To understand how the site is used and improve it
- To measure the performance of our own advertising
- To send you marketing emails, only where you have opted in
We do not sell your personal data. We do not share it with third parties for their own marketing.
4. Legal basis and consent
We process your data on the basis of the consent you give when you submit a form or accept cookies, and where necessary to perform a contract with you or to comply with law.
You may withdraw consent at any time by writing to contact@omegaxp.com. Withdrawal does not affect processing that already took place, and it may mean we can no longer provide a service you have asked for.
5. Third-party services
These services process data on our behalf and have their own privacy policies:
- Google Analytics 4 (Google LLC) aggregate traffic and behaviour analysis. Opt out at tools.google.com/dlpage/gaoptout.
- Meta Pixel (Meta Platforms, Inc.) measures the performance of our advertising and allows us to show ads to people who have visited this site. Controlled through your Facebook and Instagram ad settings.
- Microsoft Clarity (Microsoft Corporation) heatmaps and session recordings. Clarity records interaction with the page, not keystrokes in form fields, and masks text input by default. Opt out at privacy.microsoft.com.
- Google Sheets and Google Workspace (Google LLC) where form submissions and client correspondence are stored.
- Hostinger website hosting and server logs.
- Cloudflare content delivery and security filtering.
Some of these providers are outside India and your data may be transferred and stored abroad. We only use providers that offer contractual protections at least equivalent to Indian law.
6. Cookies
This site uses cookies that are necessary for it to function, and analytics cookies from the services in section 5. You can block or delete cookies through your browser settings. Blocking necessary cookies may stop parts of the site working.
7. How long we keep it
- Enquiries that do not become clients: 24 months, then deleted
- Client records: for the engagement plus 8 years, as required for tax and company law
- Analytics data: 14 months (GA4 default retention)
- Session recordings: as per Microsoft Clarity’s retention period
- Marketing subscribers: until you unsubscribe
8. Your rights
Under the Digital Personal Data Protection Act, 2023 you have the right to:
- Ask what personal data of yours we hold and how it is being processed
- Have inaccurate or incomplete data corrected
- Have your data erased, where we are not legally required to keep it
- Nominate another person to exercise these rights if you are unable to
- Raise a grievance and have it addressed
To exercise any of these, write to contact@omegaxp.com. We respond within 30 days.
9. Grievance Officer
As required under Indian law:
Adarsh Shankar Jha
Grievance Officer, Hari Har Digital Marketing Services Private Limited
3/186 Dakshinpuri, New Delhi 110062, India
contact@omegaxp.com
Complaints are acknowledged within 48 hours and resolved within 30 days. If you are not satisfied with our response, you may escalate to the Data Protection Board of India.
10. Security
We use HTTPS across the site, restrict access to client data to the two founders, and hold data with providers that maintain recognised security standards. No system is completely secure, and we cannot guarantee absolute security of data transmitted over the internet.
11. Changes
We update this policy when our practices change. The date at the top shows the current version. Material changes will be notified by email to clients and active subscribers.
